Window or not ?

    On a ground level pitched roofed extension built on the boundary line, my neighbor has opened 2 "Velux" of the side of the roof facing now my kitchen and bedroom.:eek:
    Them "Velux" are located over 3.50m from ground.
    I learnt previously :
    (a) Any window proposed at ground
    level in any such extension shall not be
    less than 1 meter from the boundary it
    faces.
    (b) Any window proposed above ground
    level in any such extension shall not be
    less than 11 meters from the boundary it
    faces.
    My questions :
    Are "Velux" considered as windows ?
    If they are not, why not :confused:?
    If they are, when they are on a pitched roof, are they considered at ground level ?
