    A friend of mine who lives in the south was pulled over in NI for using a mobile phone while driving. He was told that if he didnt provide an address in the north to post a summons to he would be arrested. He has a southern reg car. I gave him the address of someone i know in belfast and they let him go at that.

    Have the PSNI got the power to arrest people for this offence?
    What would happen if he couldn't provide an address in the north?

    He reckons he will get three penalty points now. Is this possible for an offence in the north?

    Any replies appreciated.

    If a police officer is of the opinion that a summons won't be served, they can arrest your friend and hold him for court the following morning. It allows the matter to be dealt with before your friend leaves the juristiction.

    Im not sure if he was asked to pay a fine on the spot.
    If he gets a court summons, can he get penalty points on a southern licence for an offence in NI?

    An '' on the-spot fine '' is not a fine whereby you hand over 50 or 60 quid at the side of the road to a Police Officer - it is a fixed penalty notice that require payment in 28 days usually.

    All UK Police have a power of arrest for any offence when the service of a summons is not considered to be ' practicable ' - a person non-resident in the jurisdiction would be a good example of this.
    The power of arrest is conferred by Section 25 Police and Criminal Evidence Act - many southern drivers have had an unhappy introduction to its workings.
