I bought diesel from a filling station in athboy and its known to be bad diesel and I normally don't get it from them but I did for some stupid reason now my injector pump is foooked :(

What can I do here, can I claim from them for the cost of a new pump or have I a leg to stand on at all??

Its rumored to be washed diesel there selling.

    1. Knowing its bad why did you go in?
    2. How fecked is your vehicle?
    3. Fuel receipts are king. Hope you go one or your argument won't be very strong

First thing to do is get a sample then ring Customs..

Go to a garage and to the Customs & Excise and bring a sample for examination.
If you have a report from the Customs and a garage saying its washed diesel then go to your solicitor and take them to court for damages plus hire of replacement car. You are on a winner if you get that done.

    1. Out of laziness tbh I was just coming home from work and there on the road home so said I'd fill up there
    2. Its not driving at all, will start but dies straight away.
    3. Have a receipt and paid with bank card.

I would take a sample of 5 litres or so. Then go in and ask to speak to the owner/manager. Tell them what happened and that you have a sample. You want whatever amount of money or you will go to customs and guards.

Don't contact guards until you get your money or you will never get it.

That's a form of blackmail/threat and will only get the OP in trouble.

I have a seat inca sdi there wasnt a bother on it till I got that fuel and I was literally driving on fumes before I filled it up and next day going to work I was loosing power and it was pluming black smoke in high revs

I filled up with 30 liters as always and only did about 70 miles on it and well over half a tank left in it so its no bother to get it tested

I will go into them tomorrow and demand a new pump if not I'll get the law onto them

Is it bad diesel or an airlock?
The fuel system may need to be bled, you shouldn't let diesels run down to fumes.

We bled it earlier today alright but no joy, the diesel is goin into the pump but comes straight back out

What are they gonna do? Call the guards?

Threatening to call the guards is not blackmail.

At least it is a mechanical setup so if it an injector pump it isn't too complicated or dear to repair. At worst new injectors, a pump and a fresh supply of diesel.

Best to contact customs and seek their advice

Now listen carefully, I will only say this once. Get the sample tested (JHG Analytical Services waterford approx €80.00) there are some testing required to ascertain what the make up is. I recently bought "bad diesel" turns out the concentration of bio fuel allowed in normal road diesel was too high and ruined some of the injectors, tell the garage what you are doing so they are prepared and get a response in writing, don't waste your time with a solicitor ( I did, trust me they will only dishearten you). Apply online to the small claims court its your best chance to get up to €2000.00 back, if you go to circuit court it will cost to much even if you win, the small claims is €25.00 all in, just have everything documented.

The repairs to my injectors was €1100.00

Best of luck but don't let them away with it, everyone does even though its rife.

I would be surprised if you even had to go as far as getting it tested. I know of a few cases where the garage has paid out on the first mention of involving courts/guards.

Unfortunately not, they basically called me a liar and that the sample I got tested was not from their pumps, if they start taking responsibility for all the bad diesel out there they would loose a lot of money so they will wait to see if you do anything about it, which most people don't.

Over diluting of diesel with bio fuel is the biggest problem at present ! The current legal limit is 7% but we have had samples returned with readings up to 16% . Bio fuel causes all sorts of problems with modern high pressure common rail diesels. I think over mixing in the port is the only way they have of getting rid of the stuff that is manufactured here. the yellow fields look lovely in the summer though !

If it came from Biodiesel its a slightly different case. They could have accidentally messed up the concentration so they customs and guards wouldn't have much to do with it (if at all).
In the case of washed diesel they know that if you call the customs and guards that they are looking at jail time plus thousands in fines and losing their petrol station. In that case they will pay for your injectors or fuel pump just to keep it quiet.

Independent forecourts do not mix bio with diesel it is done by the fuel companies / distributors in their storage depots when the fuel arrives in the country .

That's why you need to get it tested so you know what you are dealing with.
