Asking about gender/nationality on application forms?

    I've always wondered about this...

    As per the Equality Act 2004, employers cannot discriminate based on factors such as gender, race, etc. However I've seen many job application forms that ask you to fill out this information (usually followed by a blurb about how they don't/won't discriminate).

    Isn't this basically the same as asking you outright in an interview if you are married, have children etc? I mean they're asking you for information that they specifically are not legally allowed to discriminate against you for.

    In some occupations customers may prefer/demand a specific gender and presumable the employer must take this into account. Every piece of legislation has exceptions to it.

    Many employers ask such questions so they can keep statistics of how many applicants , what gender/nationality , etc. In otherwords they use this info to monitor their own performance in relation to equality.
