    Morning ,

I have been on sick leave for more than a year . I am back to work now since March 2012 . I have read somewhere that there is a new EU regulation that entitles the employee to accrue holidays when on sick leave ? Is that right ?
I have been working for more than 10 years in this company and usually got 25 days plus bank holidays ..Can I claim those days to my company and take them as leave ..thanks in advance for your help

I have seen this happen in a company I worked for. A worker was out for every day of the year due to sick leave and then they were paid for the bank holidays and annual leave that they did not take. In effect they were then paid for more days than there are days in the year.

It is absolutely shambolic that this can happen and I can't understand the mentality of anyone who feels they deserve to accrue annual leave days when they are absent for long periods of time.

it does happen, but in my experience it will leave a very bad impression if the company was good enough to pay you for the year. some places will not pay for extended sick leave unless it was due to a fault on the companies part. without further facts it is hard to say.

Were you hurt or injured during your course of work, or was the sick leave directly related to work. was it something that meant you could not work at all or was there a small bit of stay-at-home-itus going on?

again i only ask because some companies will get annoyed if you look for time off after having time off and it may cause a worse effect for you to go looking.

    more facts please.

    thanks.

Thanks for your reply . I was off due to a long illness .They only paid me for 6 months then I got the illness benefits . I will not ask for those holidays to be paid but maybe take those days during the year
