Advice needed

    Hi all,

    Just looking for advice.

    I put a deposit down on a second hand car about a week ago in a reputable Dublin Garage, they also agreed to take my car as a trade in.

    The car needed some slight comestic damage fixed and its NCT so they asked me to collect it on the 1st May (today).

    I got a phone call yesterday at 4.30pm saying they have just discovered that the car I have put the deposit on has finance outstanding and they cannot sell it to me.

    They are meeting with the previous owner today (as they took the car I want to buy as a trade in from this person) to discuss whats going on...but where does that leave me?

    They said they will know later today about whether I can buy the car from them or not.

    They still have my deposit and I have already paid to have my car kit taken out of my car as I was supposed to be trading it into them today.

    Do I just grin and bear it?

    I thought one of the first thing garages did when taking a car in as a trade in was check for outstanding finance?

    I have a feeling I'm being messed around.

    I'd be grateful that they made this discovery before selling the car on to you.

    In the event that the finance is not cleared then get your deposit back and keep looking all the while being happy you're not driving around in a car that somebody else is laying claim on. :)

    I suppose it's a good thing they found out about the finance.
    If that car falls through then I think you get your money back and your buy just reverses.
    These things happen and tbh it could have got quite messy if they sold it on to you.
    Hopefully they'll sort it with previous owner and everything proceeds ok.

    If you think your being messed around then do a quick check on the car on motorcheck.ie or cartell. Will cost you a few quid but if thats the car you have your heart set on may be worth it.

    Thanks for all the replies.

    I'll be checking the car history myself today just to see what I can find out about it but it seems I got off lucky this time.

    The only probelm is I cant find a car for the same price with the same spec.

    They are all about €3,000 - 4,000 more than what I'm paying.

    The finance may in fact be cleared by the last owner but not down off the bureau yet, and they're just clarifying this position. I took in a micra in march and paid the outstanding finance to bank of Scotland and got a letter stating same, it only came down from hpi today, which is normal.
    If you think it's lies, run away with your deposit... Otherwise sit tight till you hear it has been settled and see the same in writing from the finance house.

    I don't think they are messing you around. I think they did you and particularly themselves a favour by telling you before you bought it. It could work out yet if the finance was paid off but the data wasn't updated. But you are definately entitled to your deposit back but even if you don't buy another car from them I would push them for something free like a valet for the inconvience of having the car kit already removed from your old car. No harm in asking them anyway.

    Well according to the garage it will be sorted today one way or another.

    So I guess I'll just sit tight and see how it fairs out.

    Hopefully I can get the car as it ticks all the boxes.

    Nope, the previous finance is quite convoluted (there is still finance owed by the very first owner) the guy who traded it in was the second owner and he bought it privately frim the first owner WITHOUT checking for finance and it has come back to bite him in the a$$.

    I would be the third owner.

    They have given the current owner (the second guy) a week to get all the previous finance sorted even though it's not really his fault.

    Then IF it's sorted I can buy the car next week. I'm gonna hold out as I really like the car.

    It's all a bit mental really!!!

    A reputable dealer not running a car check on an incoming p/ex? That's unprofessional beyond belief :rolleyes:

    Anyway, hope it works out for you. Do what Bazz said, stay calm and polite and negotiate something out of it :)

    I couldnt believe it when they told me about the finance. The thing is, the other guy (second owner) traded the car I want, in against a very high end 2011 with all the bells and whistles and drove off no problem.

    It's only when I went to purchase his trade in did they notice the discrepancy with the cars finance.

    Yup, I'm going to go along with it until next week and see what's happens but I will definitely be looking for something as a goodwill gesture.

    I'll keep you all updated.

    Well tomorrow is the decision day about this. Either the guy has cleared the finance and I can buy the car or the garage refund my deposit.

    The garage has been in touch offering me a different car (more expensive and less spec but a year newer) but they have also listed two A5's since this whole ordeal started. I just hope that one of those A5's was not the one that the A4 was traded in against i.e. the deal is dead and they have repossessed the A5 and sent him on his way. To be honest I'm not expecting to get this A4 but I'll see what happens.
    Also by the sounds of it, I'll get nothing for the inconvenience either.

    I'll tell you what you won't get. You won't get a truck pulling up outside your house to repossess the car that should never have been sold to you.

    I'd call that a win!

    Just got off the phone to the garage and to cut a long story short the other guy couldn't get the finance sorted out so they can't sell me the car.

    That was it basically, no mention of putting me out by only giving me a days notice and me footing the bill to have my car kit removed.

    I guess I should be happy that I haven't bought a car that could be repossessed at any moment but I still feel hard done by as I'm now out of pocket €50 (The cost to remove the car kit).

    Time to keep looking and something will come up.

    Thing is, I would prefer to buy from a dealer as the thought of handing some bloke €20k and no warranty is kind of daunting.

    I do sympathise with your hassles op, but I have to say your focus on being down 50 quid when you could have been down 20k at some point in the future is pretty ridiculous.

    You're dead right I know...but it's still a kick in the spuds to be down cash / time wasted (just under two weeks) and have no new car to show at the end of it but life goes on and as has been pointed out, it could have been a hell of a lot worse.

    As I have said before thanks for all the replies.
