Advice re: JSB (Told I can't apply)

    Hi all,

    I am looking for some advice. I have rung my Citizens Information Centre and am waiting for them to call back too.

    I moved back from the UK in October 2011. I had been there since 2003 and worked there all that time. When I moved back in October I was on maternity leave (UK system).

    I then got a job in March 2012 and want to apply fot Job Seekers Benefit as it is only 3 days a week and I will be let go for 2 months from the end of May.

    When I went to my interview at the job centre today I brought all the relevant info only for the lady to say that I can't apply for Job Seekers Benefit. I asked her why & told her that I have paid 1 PRSI contribution which is what they request on question 4 here:

    She then got a bit flustered and said it is because it would take too long for the UK system to come back to them with all my info.

    So now she said I have to apply for Job Seekers Allowance even though I have stamps paid for about 7 years before I left to go to the UK (in Ireland) and I have 8 years worth of stamps paid in the UK.

    I just think she hasn't a clue, as this is not what it says in black and white on welfare.ie

    Does anyone have advice, or is it me that is wrong?

    Any advice gratefully accepted.

    Did you work in the UK in 2010 (qualifying year for JSB claims here).As for getting JSB for the days you are not working http://www.citizensinformation.ie/en/social_welfare/social_welfare_payments/social_welfare_payments_and_work/jobseekers_benefit_and_work.html

    MP22 is right, the qualifying year is 2 years previous to the current so 2010 for 2012, 2011 for 2013 etc. Why not apply for JSA? You can't work part time on that?

    It can take sometime for the UK authorities to come back with the info but you should still apply and I think its form U001(previously E301) which has to be sent to Newcastle. You can also apply for JSA in the meantime which is means tested. When the UK authorities come back with the relevant info if JSB is better for you then you can be put into payment for that.

    Yes, I worked in 2010 but was on maternity leave for part of that year (paid maternity leave)

    I am unsure if I will get JSA as it will be means tested on my husbands wages. I have been given the form U001 and will fill it in. I was unaware that I could change from JSA to JSB once they get the relevant info, so thanks for that.

    You can apply for both schemes at the one time. Insist that they take your claim for jobseekers benefit as it will only be paid from the date the claim is made. Have you filled out the application form for jsb if not then download the form from here http://www.welfare.ie/EN/Pages/jajbapplications.aspx UP1 is the form you need to download... fill it up and bring 2 x photo ID with you passport and drivers licence and proof of address e.g. recent utility bill in your name or tenancy agreement. You claim should then be registered... also bring a letter from your employer stating the date you started work and the number of days you work.(sw may give you form UP14b for your employer to complete). You should be issued with casual dockets which you have to submit every week. Be aware that one of the conditions is that you should be looking for full time work. Oh and bring the U001 form with you as well. (It might be and idea to copy the U001 form and just have it for reference in case the original goes missing). Let us know how you get on.

    Btw sw cannot refuse to take a claim from you and your claim cannot be closed while the info from Newcastle is being processed. The only way a claim can be closed is if you do not provide info requested within a certain period of time or you do not submit the casual dockets.

    I've sent through 2 separate U001 forms already and still nothing.
    I cannot seem to get any common sense or help from the UK Revenue, nor peak to a real person to help get the thing resolved.

    Meantime, I'm still signing every month and have been since January 2012.
    I'm literally going round in circles!

    Any ideas anyone?

    OP - Do you have P60's for the years you worked? That should be sufficient proof to Welfare that you've paid UK NI stamp. I supplied these when I claimed. It speeds things up a bit as we all know how the DHSS in Newcastle operates! ;)

    AFAIK - you need to have worked for two weeks here before you can bring the stamps over.

    I would appeal this if I were you.
