Breaking a contract

    Can I get some of you guys to dish out your wisdom?

    Currently working on a 3 month contract, have one month completed and it is a 200 mile daily commute. Was offered a job locally and have accepted, currently working for a recruitment agency, in my contract it states they can sack me with a weeks notice but i have to give a months notice. If i give a weeks notice what can they do? Was thinking of giving 2 weeks notice but they are going to freak when i give the notice so would rather not suffer the difficult environment for another week.

    Has anyone any experience in this situation?

    Legally speaking if there is a contract in place and you are breaching the contract the other party, in this case your current employer, can seek redress in terms of damages (money) or can get a court order to force you to carry out the term of notice (in this case a month of work).

    I cannot imagine them going down that route for a measly 3 month temp contract to be fair

    I don't know what they will do-but I am just giving you the legal implications of breaking a contract! (I've a legal background). You asked what could happen if you broke the contract and if the company really wanted to, they could pursue the routes I listed in my first post. Whether they do or not is up to them!

    I'd give the months notice but tell them you'd sooner leave asap, surely you told the new crowd your notice period was a month?

    They've offered you the job will they still look for a reference?

    It is bad form to do what you are doing, but you've your long term career to think about - someone said to me a couple of years back that I should be ruthless, I refused the advice and things worked out for the better.

    What if you have a word with the company and explained things - would they be sympathetic?
