claim back tax due to car written off

    hi all,

    I crashed a car and wrote off a car 5-dec 2011. Tax was due to expire end of March 2012. I sent in the form to claim back the tax mid Jan and subsequently got two letters from the local authority.

    Letter 1 (22-Jan) claimed that cert of destruction had not been submitted and that claim could not be processed.

    I got a second letter a few days later (1-Feb) saying I was entitled to nothing as there is less than 3mths left on tax disc.

    Cert of destruction was submitted to local authority ~1-Mar, and date on it is the 6th Dec-2011 the day after the car was crashed.

    Have I any grounds to appeal as there was 3mths left on the tax when the car was crashed?

    If date of issue of cert of destruction was more than 3 months before tax expiry date, then they are wrong and you are entitled to money back. It clearly says that in the attached link.
    There may be a difference between date of destruction and date of issue of destruction cert.

    From my understanding, you forego the first 3 months and since you used the car in December, this can't be counted, leaving Jan, Feb and Mar as your 3 months, therefore no refund.

    They werent wrong at the time though. They got the application for refund on 1st feb and rejected it because there was no cert of destruction. They only got the cert a month later. They probably dont automatically then look back over their records to see if a refund was applied for. I'd imagine he has to appeal or reapply.
