Personal injury settlements

    Hey all,

Done plenty of searching around to try and get a better idea on perspective settlement figures but the only thing that has prevailed is more confusion.

I understand that the book of quantum is used to assess by injuries board and courts but ive seen some that really look like they have been formulated some other way.

I appreciate every case and injury(ies) are unique.

Is there any sort of archive of settlement amounts either from piab or high court that could help to give ideas? When it comes to settlement youre essentially being asked to sell something that is hard to put a fair value on.

    Cheers all :-)

The book ofquantum advises on damages for the injury, there is much more to it than that such as loss of earnings and expenses from the injury, that is why the other ones you saw might be different from what it says in the book.

the answer to your question is no though!

How have people determined what a fair settlement is or are people forced to leave it entirely in the hands of their solicitor?

I've seen things like case studies in piab annual reports and articles here and there. Hoping to use these type of things to get an idea.

    Cheers all...... any help appreciated!

The instructed lawyers (solicitor and Counsel) will have the experience to advise based on expert medical (and other) reports what a reasonable settlement is.

PIAB Book of Quantum is out of date and should never be referred to (although requires that courts must have regard to it, but in practice they don't)

There is a case where the limit on general damages is discussed. It's a really poor reflection on me that I can't remember it but perhaps someone will link it for the OPs benefit.
