New contract with UPC

Hi, I am looking at changing services with UPC. I am currently paying 51 euro a month for 30meg Broadband w/ no TV. I was told that I could change to 25meg with a phone for 45 euro a month but would have to change contract and agree to another 12 month subscription.
First off, as an existing customer for over two years should I be required to agree to another 12 months (new UPC account) or should I just be allowed to change over keeping my current UPC account, without 12 month commitment?
Second, is an agreement over the phone a legally binding contract? ie. If I say 'Yes, I want to change to this new package' over the phone am I legally required to pay for 12 months subscription having never signed anything?

To answer your 1st question then the answer would be yes as it sounds like you are going on a offer that is only available to new customers
to answer your second question I am not a legal eagle but I would imagine that it is binding as it is a verbal contract and remember the calls are also recorded so if you agree to contract over the phone I would imagine that is legally binding
