NCPS Clamp Removal

    Hi there,

    Was just wondering if anyone else has had this problem.

    I got clamped this morning, I paid to get the clamp removed this afternoon. Their policy states it takes UP to 2 hours to remove the clamp. I paid at 17.49 and the car is still not released (now 20:49)

    I was meant to start a delivery job at 8pm but now the place I work for has had to get a new driver for the night as NCPS haven't shown up within the 2 hours stated in their receipt.

    As I have now lost a night's earnings due to the fact they haven't shown up, is this a significant reason to appeal and will it be taken seriously?

    Just remove the clamp yourself the next time, you won't have this problem then.

    Hard to make a statement like that considering we dont know the circumstances of the clamping..

    This is open to interpretation of the law.

    Placing a clamp on a vehicle in a place generally accessible by the public is technically interfering with a motor vehicle and thus a criminal offence. The Gardaí, in their infinite wisdom, consider calls on this matter to be a civil matter and seem to refuse to get involved.

    Removing it with an angle grinder is criminal damage, and also a criminal offence. the Gardaí, if called, will most likely slap you with a fine, arrest you, etc. which is hardly the fairest outcome.

    What's needed is someone to be clamped who can afford to take these private cúnts to court and beat them into the ground, or for law to be introduced (I say introduced as currently private clamping is not legislated for - technically only statutory authorities such as councils, or the Gardai, are allowed to clamp) by the Oireachtas.

    Park whatever way the person that owns/is running the carpark wants you to in their rules.

    The OP didnt have a rant about why they were clamped so we can only assume he didnt obey the rules.

    I was clamped recently by NCPS. My car was parked fine, it was because I didn't have a parking permit, because, you guessed it. NCPS hadn't sent it out to me in time.

    We removed the clamp without damaging it. I ain't paying these boys for the pleasure.

    Fact is nobody has ever been or ever will be taken to court for destryoying a private clamp the day it does all private clamps from the day on will be cut up rather than payed.

    I got clamped in my own apartment complex. I am not giving out about being clamped.

    All I wanted to know was if them not adhering to their policy of "up to 2 hours for clamp removal" and therefore me losing a night's work is enough basis for an appeal.

    I think you'd have a case to claim loss of earnings against them along with the refund! I wouldn't bother with the appeals (they're a joke) I'd demand full refund and compensation for loss of earnings. If they aren't forthcoming I'd bring the case to the small claims court! In effect it was a breach of contract that cost you a nights earnings and potentially your job!

    Leave your car, go home and change
    Come back with an angle grinder and a hoody on
    Leave, go home and change
    Come back, rejoice publicly at the great deed some stranger has done and drive away

    They're a private company, if they want to pursue the cost of their clamp the burden of proof will be on them to prove you were the one who cut the thing off.

    I know of a case in England where a man arrived back while his van was being clamped. The van was being clamped because he arrived back late on a prepaid ticket. He offered to pay the 30 pound fee but they insisted that they had to continue and clamp the van which would have a 90 pound fee and he would have to wait for it to be released later that day. He walked off and came back 5 mins later with a lock.
    He then took an angle grinder from his van. The clampers called the police. The police had just arrived when he had finished removing their clamp.
    He handed them their clamp, a new lock and a note with his name and address.
    The cop confirmed that it was now a civil matter and since he volunteered his details that he could go on his way. Serves them right!
