Car off the road, not taxed, now I'm selling it

    Hey,

I've had my car off the road since December as the tax and insurance were up and I didn't really need the car any more. I've given it a few months and haven't missed having the car at all, so I'm going to sell it.

I'm not sure what to do about the tax arrears, since whoever buys it will be taxing it, but I'm responsible for declaring that the car was off the road from January until now.

Any idea how I deal with this in terms of the paperwork? Do I declare it off the road at the garda station and then give the buyer the form?

    Thanks for the help!

You do nothing. The new owner is only liable for the tax from the date they buy it. I would give them a proper reciept with the date on it and a photocopy of the filled out logbook to prove to a guard that they just bought it should they be stopped

Have they bought that new rule about having to pre-declare the car off the road rather than do it retrospectively ?

That new rule hasn't come into affect yet.
I had my car off the road until 2 weeks ago and the gardai signed it with no problems or questions. :)

Hello, I hadn't heard of this new rule. Are there any catches to stop one predeclaring a convertible as off the road for 8 months of each year?

No one said it is going to happen at all.
    I hope not.

Hardly worth paying for tax just for test drives is it?

You'd be very very unlucky for it to be a problem imo.

TBH the insurance would be a bigger worry

Doubt there'd be a problem. But because of all the Garda number plate recognition system( on squad cars , motorways, toll Booths ect, ) you'd have to redeclare your car as on road or there'd be heaps of hassle....

Would one not be able to use their third party extension should it exist on their policy?

Third party extension only applies if the car is already insured AFAIK. Why not insure it and then cancel within the 14 day period? That way you get the full premium back.

This topic has come up on boards.ie many times in the past with posters having different experiences. I believe the general consensus is that the rule depends very much on your specific policy.

Not with AXA you wont, and I doubt many others will.
    (pdf)
If you cancel within the first 14 days, within the first year of insurance,
we will work out the premium for the period we have been insuring you
on a pro rata basis plus an administration charge. We will refund the
balance providing no claims have been made on your policy. You will be
charged a pro rata premium or €25 whichever is more for the period you
    were on risk.

I have a related question. My car (Toyota Celica) has been off the road for over 2 years, as my family have 2 cars and we realised when it came to tax and insure the second, we didn't really need it. So we didn't renew the tax or insurance. And obviously the NCT has also expired in the meantime. We didn't get around to selling it yet... but now we'd like to look at trading in our two cars for a new one. Does anyone know what the implications are for the car that's been off the road for over 2 years? Do I need to get tax form signed by gardai? Will they just sign it if I explain why the car hasn't been on the road? What about the NCT - will that affect its trade-in value?

If your trading it in, you don't need to do anything. The garage will have the car signed to them. However, you will have to get the car carried to the garage, either flatbed or trailer, as it is not taxed or insured, I don't think you could even tow the car.

The fact that the car has been off the road for 2 years will effect the trade in value, by quite a bit I would imagine. You might be better off getting the car NCT'd and maybe put some tax on it and then try and sell it. With some tax on it, it would not be so obovious that the car was off the road.
