Somebody cashed my cheque

    I am expecting a cheque from my insurance company. Yesterday, when I rang them for the cheque, I was told the cheque was posted a month ago and it was cashed, they also mentioned it was a crossed cheque.

    Son of b**ch, somebody else must have cashed my cheque:confused:.

    Is it possible to track which bank account that the cheque was cashed to?

    What legal action I can take? Will the person who cashed somebody else's cheque get punished? I cannot let that bust*rd go away :mad:

    If it was a crossed cheque that means it would have had to have been lodged to a specific bank account - should be easy to track down.
    Assuming that your giving the full story here then I would say an offence of fraud / theft has been committed and you should notify the Gardai so that a criminal investigation may be undertaken.

    Go back to the insurance company. They should be able to give you full details of the cheque. Chq no., to whom it was made payable, where and when cashed. If possible, get a copy of the cancelled cheque too.

    You'll need all this for the Gards in any case, I would imagine.

    If this check had your name on it and it was, in fact, deposited by someone else into his/her own bank account you have recourse against the bank itself. No way are they allowed to deposit a check with someone else's name on it into another's account. My husband cannot even deposit a check into his own account if it has his and my name on it, it has to go into a joint account.

    Also, you should determine who has custody and control of the check until it reaches you. The insurance company may be responsible for its loss.

    As per insurance company, the account that the cheque was lodged to has been identified by the bank, however, the agent refused to disclose the information, it was strange, don't I have the right to know who stole my cheque? :confused:

    Not really. If it's a theft you report it to the Gardaí who have the power to obtain the information.

    At this stage you really need to make a complaint to the Gardai who can investigate - bring any paperwork you have relating to your claim.

    chances are this is possibly just an admin error by insurance company - same name different address ...so another person with the same name has been sent a cheque from insurance company and cashes it in.

    should you check with insurance company that this has not happened !! ....oh and as others have said ...goto gardai on the matter to report it.
