Court Order Ruling ignored..

    Hypotetically ...If a court order is made for two people splitting up, where one gets to keep the house but has to pay an agreed share to the other. A deadline is set etc, then when the deadline has passed, the person who wanted to sell all along has the right then to sell the property due to the court order not being honored.

    But then the person who is in the house, and wants the house, but ignores the court order refuses to leave in the auctioneer to value etc, the other is caught between a rock and a hard place.

    A court return looms, is it possible then that the person who reneged and ignored the court could lose their share,because if not, its extra cost again for the person who wanted to sell all along.

    Anyone come across anything like this?

    The hypothetical person gets a copy of the court order served on them with a penal endorsement before the time comes for them to vacate the house. If they attempt to frustrate the hypothetical court order a hypothetical application is made to have them attached and commited to a hypothetical jail.
