airtricity and my esb account

    long story short airtricity changed my acc to them from esb without my knowledge or permission.when i got a letter from esb stating my acc was being closed i rang them nd they tld me that airtricity had requested the switchover i had my acc switched bk .soon after i received a letter from airtricity stating i owe them nearly€400.this morning i received a letter threatening court action if i do not pay.esb tld me that it is completely illegal to claim any money from me just wonderin wen this goes to court do i need a solicitor will it be my local court and could a solicitor claim his expenses from the other side as im not in a position to afford one nd am i entitled to neting from it?

    Request all the documentation from Airtricity under the data protection act... literally just a case of phoning them and saying that - there may be a small charge (less than 10 euro). Then get in contract with the regulator. You'll probably only need a solicitor if you run out of options with the industy watchdogs to be honest.

    If you do go to court and there is no contract paperwork you could go down the route of just pitching up yourself and saying... look they've no paperwork this is a scam and see how far you get but I'd recomend at least speaking to a solicitor at some point.

    Data protection ACt requests shoukld be in writing and should state that the request is being made pursuant to the Data Protection Acts.

    Ring them and let them know what you're doing though - sorry I should have been clearer. Let them know that you think this is fraudulent and you want all the info they have on you including contracts etc. In fact also tell them that you need these because you are forwarding them on to the regulator and your solicitor. It porably won't get you anywhere as they will wait for something from the regulator but atleast you might get on the a "supervisor".

    You will then need to mail in a request with a cheque for whatever fee they charge.

    Once its all over you can alway mail them another letter looking for your costs back in sorting this once they find its down to some over jellous sales guy going though you bins :)
