    I was wondering if a wife can get a top up on a mortgage without her husband knowing ? Is a bank allowed to accept signed documents without witnessing the signatures ? Can anyone shed any light on this ?

    Mortgage documents require the signatures to be witnessed by someone afaik. If the signature has been forged then both the applicant and witness are committing an offence.

    The may be a fraud offence and there may also be issues with the Family Home Protection Act, but that would need to be checked.

    Thank you. That maybe something to have a look at. The person in question also emptied out her husbands government savings scheme account after forging he name on a document that they gave her to bring home and that account was in his name only. I know it is extremely odd for a wife to do such a thing. They have tree children the oldest being thirteen and she also took the money out of their piggy banks. But the oddest thing about it is when asked what she did with the money all she says is " I can't remember " or " I don't know " which leaves this man at his wits end. Would he have any redress form the bank for accepting a forged document and or not having witnessed them being signed ? This woman was very familiar with all the bank staff and they likewise were very familiar with her all being on first name basis. They just took her word that her husband was sick and couldn't come to sign for the top up. Where do you start ? What do you do ?
