3 day week and bank hols

    Unfortunately i've had to put an employee on a 3 day week. afaik one's entitled to 12 days hols instead of 20. just wondering how do bank hols work? i want to tow the line legally and morally too!
    person works wed, thurs, and fridays.

    Presuming the employee would normally be working an 8 hour day/40 hour week and is now working 60% of this (8x3=24 hours) they would be entitled to pro rata time off in lieu of the bank holiday.

    Most bank holidays fall on a Monday. St Patrick's Day, Christmas Day and St Stephen's Day may fall on another weekday.

    As your employee is off each Monday anyway, they are entitled to 4 hrs 48 mins off in lieu for bank holidays which fall on a Monday (as the holiday has to have some value to them).

    Should the bank holiday fall on a day that they were due to work (Wed, Thur, Fri) they are entitled to 4 hrs 48 mins off. If the business does not operate on a bank holiday and they are given the full day off you would be entitled to recoup the outstanding time (3hrs 12 mins). The easiest way to do that would be to offset it against the time they are owed for bank holidays which fall on a Monday.

    I hope this is helpful and again please note the figures are based on an 8 hour day.

    Edit: New Year's Day may also fall on a day other than a Monday.
