Duplicate content - still an issue?

    I posted the rough details of this on the SEO forum but that seems to be a bit dead. Basically I've been working on building an Irish search engine and of the sites surveyed, approximately 14K of them are duplicate content. They are clones. The reason for this is that they use multiple domain names, sometimes generic or keyword rich, to point to the main website. The problem is, from a search engine developer's point of view, that they are not 301ed. This means that when they are spidered, they appear as individual websites.

    Do search engines still penalise duplicate content sites?

    Has Google or Bing figured out how to determine which of the sites in a group of duplicate content sites is the genuine site?
