i'm in the middle of "getting" my claim sorted out by above company...all went well till they start looking at one of my tyres which is pretty wear off...and unfortunatelly above RSA limit of 1.6mm...

first i was told because ofd that certain amount might be deducted from final agreed...but after todays call it looks like they looking of not paying at all !

i was trying to find aprop. details regarding terms & condition but i can't find any manual over the net ( insured through broker )...can they really do not pay anyting because of that ?

    thanks

Was the worn tyre a contributory factor in the accident?

Thinks you'll be needing a solicitor.

Sounds normal. Its up to you to keep your car in a road worthy condition. Below 1.6mm is not acceptable.

i was told by aviva agent that "tyre condition didn't had any impact on the accident" from that..my concern...so looks like it's all in their insurance policies

O.K.. well from that can you not advise Aviva that the agent even specifically noted that the condition of the tyres had no relation to the nature of the claim?

Send them a written complaint outlining the tyre condition was not a proximate cause or indeed related to the incident and request a final response, get final response go to ombudsman and claim full amount of claim and inconvenience of a few bob too.
