Tax out on commerical van

    Hi all,
    I was asked by a friend today about a van he has. The story is it broke down last April, timing belt problem. He got his mechanic to tow it to the mechanics garage. The tax on that van expired last July, he did however maintain comp insurance and the van is still insured to this day.

    His query is since the van broke down he did not have the funds to get the engine fixed. It is still parked up but he is hoping to get it fixed shortly.

    So the tax is out since July 2011, obviously it has to get a DOE test in order that the van can be taxed again. Of course once he drives it, he is committing an offence, would a Garda accept that he is driving it from the garage to the DOE centre and then perhaps the local motor tax office, and perhaps allow this without prosecution?

    Also does anyone know this, has the law re motor tax been changed in the last budget, before if a vehicle was off the road, then the tax did not have to be paid. But now he thinks that once you own a vehicle it has to be paid. So as his van has been off the road for the bones of a year and the fact that the law was changed during this period, does he now have to pay all that outstanding tax, or just the months before the law was changed.

    In regards driving to the DOE centre he can do so legally once he can prove he's going there. Driving to and home from a DOE test is an exemption. That being said however, he still has to be taxed but can't take it without a cert so its a catch 22. It really is down to the Garda on the day.

    He can go to a Garda station and declare the vehicle off the road in regards tax for the last few months, once he hadn't driven it.
