Planning & Development contribution fee

    Hello

    Does anyone know if you can claim a refund for the Planning and development contribution fee?
    basically got planning for house but due to unforseen circumstances cannot afford to build therefore planning will run out in few months.
    can you claim this fee?

    i think this is a question you should aim directly at your local authority.

    The fact that you havent constructed a dwelling to utilise the services you have paid for, is grounds for a refund in my opinion.... becuase technically you havent received any service

    I dont think you will have any luck getting money back. You must have informed them of commencement if they billed you (thats how it works here anyway) and as such you are underway with the development. Extend your planning for a further 5 years if you have not already done so.

    Yes you can, provided you did not start works, submitting a commencement notice is not starting works.

    Just wondering why the OP paid 'development contribution fee' if they were not going to commence construction? As mickdw suggests, they only have to be paid when you commence construction.

    Thanks for replies.
    Well basically we paid it to get one bill out of way before we'd start work but over night circumstances changed!!

    Finally got in touch with local planning office late this evening and they have informed me that "yes you can claim a refund" after 5years are up once no work has begun.

    Seems a bit rough! I assume you did not submit a commencement notice?

    Worth further investigation I would suggest. An in depth look into the planning acts and/or maybe write to the council asking them to explain to you on what basis they are retaining the money?

    If you do not intend to build (now) does not seem fair that they can retain money for that length of time.

    Definately going to look into it further,thanks for advice. I didnt submit a commencement notice.

    Will post back update in coming weeks to inform followers of the outcome.
