Am I due back Pay?

    Not sure if the is the right forum, so Mods feel free to move as required.

    I work for a national retail outlet, and due to the economy I am facing Redundancy. No issue there, but during the calculations for my redundancy pay it was discovered that I had been paid only €12.00 per hour and not the €13.42 I was contracted for.
    I have been told that I am only entitled to 1 years back pay correction, although the underpayment goes back to my commencement.

    Any ideas if this is correct or not?

    Do you mean throughout your entire contract you were paid the wrong rate of pay? How long have you worked there?

    just over 3.5 years

    My hourerly pay was calculated back from my agreed annual salary, but worked out for a 42.5 hour week, and I was contracted for a 38 hour week.

    It was difficult to spot because of bank hliday / sunday premiums an commission

    But yes it looks like it wa the full term

    I'm sorry, your issue seems very unclear, did you have an annual salary or an hourly rate?

    I had a salaried position, however as I also was entitled to Sunday and bank holiday premiums, and occasionally overtime (over and above the base rate) all payments were calculated from an base hourly rate.

    The base rate was worked out, as outlined above, by salary/52 weeks/38hours,
    although mine was worked from a 42.5 hour week instaed
