Used car warranty

    I bought a used Almera two weeks ago and the front passenger side brake calliper seems to be jammed. Would this be covered under warranty and could anyone point me to a website which says what's covered and what isn't.

    Need to know by the morning if possible as the dealer thinks it might not be covered.

    What company provided the warranty? Mapfre or the likes or is it the dealer himself?

    If it's reasonable to assume that it was in that condition (i.e. defective) when you bought the car then it is covered, any sale by a dealer to a consumer carries an assumed warranty and after only two weeks you are well within your right to get him to fix it.

    Didn't you ask about the warranty when you bought the car? Can't believe he's trying to weasel out of it after only two frigging weeks!

    Warranty is through the dealer. Well the car has been grand for the last two weeks only today that I noticed it was sluggish and making noise while driving home and got out to find the brakes smoking.

    Not sure if he's trying to weasel out he just said he's not sure if brakes are covered that he'd have to check as I was finishing talking to him. Just want to be sure of my rights in case he goes any further with it. I'd assume the pads aren't covered as they're consumable but a fault with the calipers surely is.

    I don't mean this to sound unhelpful, but if you don't have it in writing that something is covered then it isn't. Did you get a warranty booklet when you bought the car. If so that will explain exactly what is and isn't covered, and for how long. If not then you're down to goodwill. To look on the bright side, a caliper for an Almera shouldn't cost crazy money either way.

    All I have in writing is that there is a 3 month warranty on the car on the invoice. Never got any warranty booklet but I assume theres a minimum standard of warranty you have to be given by law.

    That's what I'm unsure of as he never said. I was hoping there was some minimum standard warranty I could look at but all I can find on citizens information is that the warranty is the same as any other one for goods that the vehicle has to be 'fit for purpose'.

    I'd say wear and tear items - brakes, clutch, tyres etc. are highly unlikely to be covered.

    I'd agree. Unlikely to be covered, however try and put pressure on him because the car was only bought 2 weeks ago. Tell him you have a 3 month warranty and you expect it to be covered.

    Any goods a customer buys must be of good sound quality now unless you have done 2000 miles it is reasonable to assume that it was defective before you purchassed it he may try to fob you off with a engine/gearbox warranty however if you bought a drill or a vacum cleaner and after a month they began to bellow smoke what would you do. In this situtation you do not need a warranty to cover you from a dealer. He has to fix it

    Thankfully this got sorted in the end, took a bit of arguing but when I asked a mechanic who sells cars what should be generally covered and put that to the garage I bought it from they agreed to cover the cost of repair straight away. Suppose they'll chance their arm with everyone because of the recession because most people will just go along with it.
