Planning Dilemma

    Hi Folks,

    I am new to posting on boards.ie but I do find it very helpful for solving problems.

    Here is my planning dilemma.........

    I have the chance to purchase a site subject to planning permission in a pressure area/area of strong urban influence.

    The criteria to be passed in order to receive planning permission are as follows.......

    1) I have to be living in the area since before 2000. I pass this as I was born in the area in the 70's and I am still living in the area 30+ years later.

    2) I have to have a need for housing. I fail this criteria as I live in my own 3 bed terrace with my partner and 3 kids.

    I currently have my 3 bed up for sale but I am under a time constraint with the site owner as he wants me to be a long way through the planning process by July 2012. If I am not he will take other offers on the site.

    I will definitely have to sell my house in order to build as finances are tight. So in theory I will have no house once the build begins.

    My brother has given me the permission to use his name on the PP application. He never intends to build in the area or even in the province and he passes the above 2 criteria.

    Below are my questions...............

    1) I am 99% sure that using my brothers name for the PP application will definitely sort out the planning issue but will there be a problem with the Bank if I go for the mortgage and the PP is in my brothers name?

    2) The deeds of the site would be in my brothers name if I took the above route. Would it cost a small fortune to have the deeds put in my name or is this possible?

    Any additional solutions to my dilemma would be well appreciated.

    Please read the forum charter before posting again, we don't allow discussions on how to 'get around' the planning laws. If you already own a house I would say you don't qualify as having a housing need.

    Thread locked and infraction given.
