here goes in 2007 my self and the missus got a mortgage on a 1 acre site on a part of my farm, we dealt with a solicitor and drew down or mortgage, part of the agreed deal was of course to have a seperate folio for the site, but i noticed that in fact the mortgage was on one of the farm folios, in 2009 my aunt transfered a seperate 1 acre piece of land with barns etc, now in the mean time the woman i was dealing with left the practise and the new woman then put the mortgage on the barns , WHAT A MESS , again to my annoyance i told the solicitor to set up a new folio, so she requested the bank release deeds on barns with the undertaking the new folio would be set up, this is where it really gets complicated, solicitor goes out of business and my files are transfered to solicitor 2 who is very reluctant to stand over any of the undertakings of solicitor 1, now i have a situation where the bank has or has not any rights to my house, they certainly have an understanding from a solicitor who is out of business, would just like to add i have never missed a payment and dont intend too, thanks for reading all opinions welcome

Impossible to give a clear and reasoned opinion to this. Too complex and too much information missing. I'd suggest that you talk to your current solicitor and try and resolve this or get a second opinion. Potential negligence on the part of the first solicitor, who would have been insured so potentially, it doesn't necessarily matter that they are out of business.

Again, talk to your existing solicitor or talk to another one for a second opinion.
