Work contract issue

    I have a contract that says I should paid on the last day of the month.
    Recently I have been getting a cheque ( takes 5 days to clear) or an international transfer ( taking 2 days to clear)
    Is my employer breaking the contract by paying me this way?
    Should the money not be in my account on the last day?

    i'm basically just wondering if i am within my rights legally to say that if he is paying me by cheque that he should give it to me 5 days before the last day of the month so the funds are available to me on the last day?

    When is the money physically leaving their bank? If it's the last day of the month then I would suggest that you have an issue with the banking system rather than your employer.

    Without wanting to sound rude this does seem to be some what of a molehill issue if you are being paid regally within a few days of the end of the month.

    the money leaves my employers bank on the same day i get paid.

    i know it doesn't seem like a major issue but i have payments that i need to make on the 1st of the month (that cannot be but back to a later date) and i feel that if i am contracted to be paid on the last day of the month the funds should be available to me on that day.

    I wouldn't have thought "clearing" would be deemed "in their account". I'm speaking here from dealing with staff rather than a legal point of view.

    To the other point I would have thought if it was always happening you should just leave some money in your account... just my 2 peneths worth...

    I don;t mean to sound flippant here I'm just trying to give you the the other side of the argument. In all honesty it probably should be in your account but I don't know if it's serious enough to be considered a material breach. Even if it where what do you hope to achieve beyond what you could at the moment with a chat to your employer.
