Incorrect time speeding ticket

    Hi all,
    I got a speeding offence notification in the post, giving me an 80euro fine and 2 points for speeding at a certain time on a certain date. Now I know at the time stated on the notification, I was at home and my car was parked outside. It is possible however that the clock on the speed camera was out by an hour as I did pass an hour earlier. I have a text that I sent to someone saying that I was home that I sent when I got home five minutes after I passed the camera. Maybe the speed recorded was also out if the time was incorrect

    Should I fight this or should I just pay the fine and say nothing. How would I go about fighting this?

    I don't believe I was going particularly fast that night and I normally stay within speed limits but I may have been overtaking something.

    You amay have a defence IF you can actively prove you were not at the location shown at the time shown.

    However,that burden of proof is yours.

    The State does have a problem IF it can be proven that any element of the recording apparatus was/is incorrectly calibrated,but again you need to be able to prove that to a Court.

    Are the clocks on the speed cameras properly set up for the change to/from British summertime?

    tbh unless it was a very serious charge or there were implications for my licence (e.g. these 2 points would put me off road or increase my insurance, etc.) I personally wouldn't bother

    Ask your solicitor to request your service provider for a print out of the your mobile phones location (cell site analysis) during the disputed times.

    The speed camera presumably took a picture of the vehicle at the time of the speeding offense... Would the alleged offender not have a right to a copy of such picture?

    You should get one now with your Fixed penalty notice.
    Ask your solicitor to request your service provider for a print out of the your mobile phones location (cell site analysis) during the disputed times.

    This won't be produced unless it's requested for by the Gardaí.
