When a body is exempt from a section of the Freedom of Information act can it be appealed to the FOI Commissioner or is the exemption complete always

Section 21 (1) (b) of the Freedom of Information Act says it can be refused if it would "have a significant, adverse effect on the performance by the body of any of its functions relating to management (including industrial relations and management of its staff")

Is this exemption automatic or would the organisation have to satisfy the FOI Commissioner of the adverse effect
