Right of Election in relation to LRS and Independent Legal Advice

If you are handling a grant of probate in relation to the spouse of a deceased does "independent legal advice" mean you have explained the situation in relation to the right of election,S115, Legal right Share etc. to them in a room on their own or does it mean that you advise them to go to an entirely separate legal firm…

For independent legal advice the person concerned should have a consultation with a separate independent solicitor. That solicitor should be supplied with all relevant documentation
