Right of Election in relation to LRS and Independent Legal Advice

    If you are handling a grant of probate in relation to the spouse of a deceased does "independent legal advice" mean you have explained the situation in relation to the right of election,S115, Legal right Share etc. to them in a room on their own or does it mean that you advise them to go to an entirely separate legal firm to get the advice.

    For independent legal advice the person concerned should have a consultation with a separate independent solicitor. That solicitor should be supplied with all relevant documentation
