Hello, new to this. I was wondering what possible outcome there would be for a single mother leaving an EU country and returning to Ireland with two children with Irish citizenship, where the mother is unmarried, does not live with the national of that country, his name is not on child's birth cert, she has sole custody/guardianship with Irish and other country's affidavit attesting to her being sole guardian. Would the father have recourse to the courts of that country and is this more a citizenship card or more sole guardianship card?

    Whats the EU country

In Ireland if the father has guardianship its illegal to move out of the country without his permission but since he doesn't have guardianship he doesn't have any right to stop you leaving the country through the courts I don't know if other countries have different laws

    The EU country is Italy.

The Irish Department of Foreign Affairs should be able to advise you. They used to (still do?) have someone who is designated to support citizen families in this type of situation. Your case appears cut and dried (to a non expert), but other cases and countries present more difficulties for all involved.
