friend of mine tried to setup a business. He stopped trading after3 months, hit by the recession. He had been let go from his job a couple of weeks before he started trading. He had been working full time and paying full PAYE and PRSI for a number of years up till September 2011. Can he claim JSB on the basis of these years payments into the social welfare system? His partner is employed so if he is refused JSB he knows he cannot get JSA.

As long as he is now unemployed (ie working three days or less) and is genuinely looking for and available for full-time work he can make the claim. He will of course need the right number of employee stamps and employee stamps in the right years, if he does, he can claim Jobseekers Benefit.

The only reason previously self employed people are denied Jobseekers Benefit is when they don't have the necessary Class A stamps. Someone who has been doing employee work at the same time as being self employed is fine.

Your Jobseekers Benefit payment will be based on your average PAYE earnings in 2010. If you were earning more than 300 Euro as an employee in that year, you'll get the full rate of Jobseekers Benefit.

On the Jobseekers Allowance, make sure that your friend has gone over the figures. A lot of people underestimate the amount that a partner can earn while still keeping their payment.
