Advice please - is garage liable ?

    Ok the gist of the story is as follows.. Bought a citroen c crosser 2008 for 14 k couple of weeks ago from a garage in Dublin. Noticed clutch bit funny few days later but wanted my husband to drive it . He said clutch was slipping ( altho not badly) & we rang the garage ( had jeep 6 days now). Garage said clutch wasn't covered & that I could have driven it in such a way that caused the problem. However they said they would cover labour if we covered parts ie about 400 euro. Nothing was put in writing but the plan was to drop the car in tomorrow. Meanwhile I rang the consumer associate iation of Ireland & they felt the garage should be paying all the repair cost. The clutch is not covered on warranty but they said a warranty is only in addition to statutory rights & that the vehicle we were sold is not fit for it's job. Armed with this we tried to contact garage but now are being completely ignored. Keep saying will ring us back, guy we dealing with not there etc etc. So now looks like we will be getting zilch off them. What do ye reckon we are or aren't entitled to ?? Thought the lads in garage were bit dodge ( in Ballymount !) but took the chance.

    Clutch is a wear and tear item, and is expected to wear out at some point.

    If it was slipping when you bought the car, it should have gone straight back (or even been noted after the test drive and fixed before you collected it).

    Sounds like the garage were being pretty understanding to begin with, but when you didn't take them up on their kind offer, they are now digging their heels in.

    You'll have great fun trying to get anything out of a dealer in the Ballymount Triangle (where ******* dissapears.......)

    Yeah I should have checked here before buying about the Ballymount dealers ! We were happy to take them up on offer but now they seem to be gone bit underground. Live & learn I suppose !

    Can you find out who the previous owner was, and contact them?

    If they indicate that the garage knew about the clutch issue, then you have a case - they would have knowingly sold you a vehicle which wasn't fit for purpose.

    You thought they were a bit dodge but took the chance and threw €14K at them for a 2nd hand car?

    Well had zero evidence they were dodge but they were bit rough around the edges( don't want to sound like a snobby cow saying that !) . Have finally got in touch with them & they are offering free labour if we cover parts. From what all above have said we should gratefully accept ! No history of previous owner got

    Unfortunately the clutch is one of those things a driver can easily wear out, through a variety of ways. A garage has no way of knowing if it was a problem before you got it, or caused by you.
