Apparently a person lives with us, rent allowance cut.

    Hi guys just posting this on behalf of a friend of mine.

    He moved into a two bed apartment a few years ago.

    Three people lived there.

    Himself, girlfriend and friend.

    Himself and his friend were receiving rent allowance and his girlfriend was working.

    They each paid rent split between them.

    Last year the girlfriend moved out and the two guys stayed on, she visits him some times but is not living there.

    The two guys had their rent allowance cut completly because the social think she is living there.

    Any advise or what can they do?

    They should have had a letter from the CWO stating that rent allowance was being cut and why. The option to appeal and how to appeal is set out in this letter. They should appeal the desicion immediately including in the appeal documentary evidence that this girl no longer lives there. Documentary evidence would include copies of documentation adressed to her at her new address. For example very recent household bills, bank statements, tax credit certificates, P60s, rent book etc. you get the picture. as much evidence as possible. No point appealing if you cant produce the evidence. The onus is on the rent allowance applicant to prove she is not living there.

    She moved back home with her parents to save because she will be leaving ireland to train for her job.

    From the above it appears you friend was not entitled to rent allowance at the time as he was co-hab with someone who was in full time employment.

    last poster is correct. there was 3 sharing the rent and only 2 claiming rent because she was working then I am afriad that is fraud. They must have had some evidence to cut you off.

    Well they didn't lie when they first applied for rent allowance the cwo knew she was living there.

    makes no sense if cwo knew she was living there and working then the rent should have been split or the couple wouldnt have got it and the single person would have. doesnt sound like they knew.

    They're living there four years and they cwo even visited the place when they first moved in.

    The gf was a full time student up to last year but moved out and is working full time now.

    Their only options is to move out and get seperate places or move back home.

    You would think wouldn't you?? I got cut off my rent allowance in September (haven't paid rent since) and they never forewarned me or sent out a letter of explanation. I had to get a local TD involved, and only then did I find out that I was falsely reported for working while claiming (I wasn't!!) and so they cut me off. No investigation, no letter, no explanation...nothing!! :mad:

    I went to the CWO and she said it was up to me to prove I wasn't working. How the F**K am I supposed to do that???? Anyway, I've had to appeal it, the appeal is gone into D'Olier St. about 3 weeks, so I guess I'll just have to wait about 6 months while some useless pile of sh!te decides to get off their arse to do something about it!

    Maybe your friend did not declare that he was co-hab with gf. Anyway your friend and his friend are being investigated in relation to rent allowance.

    In your OP you stated gf was working.???

    The tree of you guys were living together and collecting rent allowance. Your girl was on the lease while she was in collage, she finished collage and got a job then decided to move back home.
    Then CWO will look at it and say here is 3 people who live together 1 gets a job and now realizes that she will have to pay rent out of her own pocket. If she says she has moved home the two lads can still claim rent allowance and she can stay over when ever she wants. This may not be the true but it is probably the way the CWO see's it. You need to prove to the CWO that your girl doesn't live with you any more how you do that is not too hard, show them your tax cert from the new job. It's a good one if you get away with it.

    PMSL! I actually told her to send someone to my house at any time of the day and I'd be there looking after my two kids, but she declined. I think she was afraid of being proven wrong. :mad:
