How to get work permit

    hi guys, i my friend is in a bit of pickle and is looking for a small help but i dont know where to point him...

    he send all his documents regarding work permit as he is working in tesco...
    now he received negative response from department and now he is pissed because of few reasons...

    there is a problem because its required to work full time of 39h and earn 30k annually which is impossible because he is on student visa.

    what he told me is that he dont understand how is it possible for someone who is working same job like him but different shop and how a girl from same country as he is, doing cleaning in a hotel and she got work permit after 2 months...

    can u plz refer me where should i point him cause ive never heard for such thing...

    Doesn't the student visa already allow him to work for 20 hours?

    What sort of visa was he looking for?

    What does the letter he got say about an appeal process?

    If he has a student visa then he is allowed to work 20 hours per week and does not need a work permit.
    The student visa and work permit are two different categories of permission/right to stay in the country.

    Is your friend approaching the end of his studies and wants to apply for a work permit? Or trying to change category?

    Depending on the particular job he may be ineligible, see here:

    Ok, i see someone didn't understand.

    Curently he is student, part time work of 20h with stamp 2.
    His education is comming to an end so last december he applied for work permint and this monday he got negative for it, stating that he is not eligible for it.
    Usually when u get work permit u get stamp 4 i think.
    Now what he dont understand is how is it possible that he after working for so long in one place no matter for what kind of job is cant get WP, and someone else got it with being working same job in different shop or even worst got WP with being cleaner in hotel.

    I was wondering too because that doesnt seems normal

    I am thinking that perhaps the someone else should not have got it either.

    Unless he's doing a fairly specialist job, then I don't think that it's automatic that he gets a WP just because he's been doing the job. For most hotel and shop jobs, there are plenty of people who don't need a work permit who could do them.

    as i mentioned, both of them work same or worse job than i do...
    one of them is cleaner, other sale assistant

    Why did he get rejected? What did he study? Where is he and this other girl from?

    girl and him are from croatia, he (friend) was studying business and she came in here last august.

    the guy she got married is also from croatia but he is here on work permit for last 4y..
    she got stamp 3 because of that but 2 months after she got work permit too on cleaning job in hotel...

    She would have been entitled to live and work here through marriage to a person entitled to live/work here. Initially she would have the right to stay and could then apply for a work permit.

    Your friend on the student visa is/was entitled to work 20 hours per week. Time spent in Ireland on this type of visa does not count for long-term residency applications. (Student visa holders aer only considered temporary residents)
    Rules for work permits changed a few years ago. Citizens Information website has some good information. Main points are that the salary has to be more than €30,000 and a labour market needs test has to be carried out. The employer has to advertise the job for 8 weeks and if an EEA national does not apply they can then offer to non-EEA nationals/help with work-permits. AFAIK Cleaner/sales assistant would not qualify. Further, looking at Tesco's website they state that they will not assist with work permits:
    "Can I apply if I don't have a full work-permit?
    No. We can only consider applications from those with a full and valid permit to work in the country in which they are seeking employment."

    Good news is, if the course is eligible, your friend can apply for the graduate scheme. Further good news is that Croatia are due to join the EU (probably towards the end of the year), so most of this will be less relevant.

    I'm not sure of the situation in Ireland as I've not researched it fully, but I do know that in other countries you cannot apply for a work permit/work visa while you are in the country you are applying for.
    You have to leave the country and apply from outside before the application is considered.

    As a married person to someone who have stamp 4, in my opinion and by some things ive read, she dont have any rights to work from 6-12 months and u have eligible for wp...

    basicly its not tesco fault...
    the problem was in :

    usually have to work 39h or earn 30k a year...
    but
    if you are student u can work 20h and earn something closer to 20k i think...

    and his job does not apply for wp...

    but question is, how is it possible for someone else, not in tesco but similar shop, who is working as a sale assistant get wp...

    im trying to help him but i dont know how anymore...
