    Just wondering with regards to warnings, the company my mate works in is saying if they don't reach their targets they're a possiblity of an official warning, the contract isn't a bonus based contract nor a commission based job, how legal is this approach?

    Is it in the contract that they have to reach their targets or they can be dismissed through a series of warnings? It usually goes verbal warning, a written warning, followed by a final written warning, and then you're gone.

    Sales companies build this into their contracts as a way of getting rid of poor performing salespeople.

    Afaik there is nothing in the contract, I'll double check with him tomorrow. If there is nothing in the contract can it be enforced or would a new contract have to be signed in order for that?

    EDIT: Btw this is just a bog standard retail job where everyone is a salesperson.

    Failure to perform has always been a reason to let a person go. If there are stated goals of expected sales and a person fails to reach this then yes, on performance grounds, your friend can be walked down the route of warnings etc.
