Resignation on sick leave

    I am currently out of work on sick leave (personal issues). I work in an stressful research role and know deep down I'll never be able to return to this position.

    I have been offered an opportunity to work closely with a former colleague in a less stressful environment. I want to hand in my notice to current employer as I feel guilty about them keeping my position open.

    I am just wondering can I give notice while on sick leave and if so do I get payed in lieu of notice? The notice period is 6 weeks so if I give 6 weeks notice will I be paid for the six weeks in the same way I would if I was actively working? Also I have circa 5 days annual leave from 2011 will I be paid for these?

    Sorry for all the questions.

    Is your sick leave paid or unpaid?

    TBH, I think the honourable thing for you to do is resign now, and negotigate a reduced notice period - I suspect your employer will be very willing to agree.

    You should get paid out any a/l owing, though.

    A friend of mine was in the same position as you a few years ago. They were out on sick leave when they decided they could no longer go back to the job the had. They found a new job and give the normal notice to the company they worked for.
    In your case I am sure you present employer well let you go with less than 6 weeks notice. I would say that you have been offered a new job, that you enjoyed work for them and that you are owed some holiday pay.
