    Hi there,

    in need of some advice re a claim,

    In short I recently got hit side on by a car coming out of a side road and failed to stop while cycling home on a sunny afternoon recently. six hours in casualty and recovering from neck and leg injuries. Bike was brought to LBS for a quotation and quickly written off along with gear and as I was on my good bike the replacement cost is nearly 5k.....No immediate witnesses and liability yet to be admitted.

    loss adjustor wants to see the bike without predjudice and make an offer subject to the driver admitting liability.

    now I'm wondering if the offer of costs is below (which I presume is usually the case) and I'm not happy, what are my options?

    I must add that I have yet to receive hospital bills and have spoken to the guards who state from the evidence I have a claim against the drivers insurance. I have not made a formal statement but have prepared one and spoken to my solicitor....


    any advice or experience much appreciated,

    To be fair, there are loads of previous threads of how to deal with accident claims - I don't see this as being much different and the OP is seeking professional legal advice already.

    Respecting the mods Advice. I have been hit by a car in pat from the side.
    Bike was totalled but I wasn't injured.

    Liability admitted by driver.

    In my case the insurance company were very quick and eager to pay for the full cost of replacement of bike and clothing etc.
    It happened on a Saturday. By the following Friday I had a new frame.

    Apologies to Mods but my query was not intended to solicit free legal /professional advice,

    As stated, I have already spoken to my solicitor and was just wondering what peoples practical experience in negotiating with a loss assessor /adjustor and general outcomes.

    hopefully no harm done and thanks guys for the feedback..

    Obviously not professional advice but just my experience dealing with insurance companies/loss adjusters.

    I don't think you'll have any much problem with the claim for the bike, as long as it's available for inspection and the quotation/write off letter is from a reputable shop they'll just want to settle assuming of course that the other party admits liability. You might have to show the invoice for the original purchase and get some documentation to show the price now of an equivalent new model but I'd negotiate very strongly for direct replacement with a brand new bike, most all risks policies now are on the basis of new for old.

    The thing that might complicate the above is if you are claiming for personal injuries.

    Remember too that the loss adjuster is representing the insurance company despite the impression he might give you, you are entitled to get one of your own if you think it's needed, take advice from your solicitor here.

    PS if you have the bike insured yourself tell your company whats happening, it may be better for you to claim on that policy and let the two companies fight it out,it's all extra cost though and another incentive for the loss adjuster now to sort you out properly up front.



    Again this is based on my personal experience dealing with a few different insurance companies over the last few years on behalf of myself and various family members.

    Apologies, I misread the OP, and did not pick up he had already spoken to a solicitor.

    Having said that, and having been in a similar position myself involving personal injury, the best advice the OP can get is from a solicitor.
