eMobile Phone Insurance Question

    Hi there. Just have a question regarding my emobile phone.

    I signed up for a new eMobile contract last year for one year and i received a new HTC phone. At the time I had an iPhone, so I gave my brother the free HTC phone that I got with eMobile. He decided to pay for the insurance on it, which was €6 per month or something like that.

    Just recently the phone has been stolen, so he wasnts to claim it back on the inusrance he has been paying for.

    Now, since the account is in my name and he has been using the phone, can eMobile or the insurance company claim that our details are incorrect and he shouldn't be using the phone? Hence, he recieves nothing... Or can I register him as the phone user with eMobile? Or register him as the account name?

    I don't want to get caught out with these companies and receive nothing...

    You make the claim, it's in your name and the insurance is being paid in your name. Don't bring your brother into it. They won't pay up as it's not his to claim on.

    But does it not come up in their system that I haven't been using the phone for the past year? And since it's not my sim card that's missing, will that not also come up in their system that the sim card is still in use?

    No the insurance company won't have access to that information and even if they did it's besides the point. I have my ferrari in the garage for the last 2 years and i'm paying insurance on it. Do you think the insurance company can swing around and say were not paying up because I haven't used it. It's irrelevant once i'm paying the insurance.

    When you do make a claim and the dust has settled make sure and update the insurance with the IMEI of your phone.

    Exactly, your brother was not an authorised user so if you say it was him that lost it then your claim would be rejected.

    Well when I was working for Vodafone if you lost the phone without your sim you weren't covered. Been working for emobile for a while now and haven't delved deep into the terms and conditions yet. I'll have a look and post back later.

    D) The insurance: what is not covered

    1. Any phone with a replacement cost of more than 400. (pounds I'm assuming as it's a UK company)

    2. PDAs (personal digital assistants without phone capability) and other portable devices without phone capability.

    3. Any mechanical or electronic breakdown that takes place when your phone is still under its manufacturers warranty.

    4. Loss, theft, damage or breakdown if this happens whilst your phone is being used by someone who is not registered on your policy as an authorised user.

    5. Any phone that does not contain a SIM card at the time of the incident claimed for.

    6. Theft where your phone has been stolen from a car or other vehicle, unless the phone was out of sight, the vehicles security systems were activated and there is evidence that the vehicle has been broken into.

    7. Damage, loss or theft where you havent taken reasonable precautions to prevent this or where you have been reckless about or indifferent to the risk of damage, loss or theft taking place. Examples include wilfully or recklessly leaving your phone unattended in a public place or leaving it on the bonnet, boot or roof of a vehicle.

    8. Loss or theft of your phone from any property or premises unless there is evidence of a break-in.

    9. Damage caused by your careless use of your phone. This includes (but is not restricted to) damage caused because you have not followed the manufacturers instructions or because you have used the wrong voltage to charge up your phone or because someone else (for example a retailer) has set up your phone wrongly.

    10. Damage if this is due to your phone being put in a washing machine. This is irrespective of whether this was accidental or not.

    11. Damage or breakdown if we cannot verify the IMEI number of the phone that you have returned to us for examination.

    12. Damage caused by any electronic virus.

    13. Malicious damage to your phone caused by someone else if you have given them permission to use it.

    14. Repair costs if these are not approved by us first.

    15. Costs of routine servicing, inspections, adjustments or cleaning.

    16. Normal wear and tear, including surface cracks, flaws, scratches or chips.

    17. Consequential loss. This is where you incur a cost or expense or suffer a loss as a result of the loss, theft, damage or breakdown of your phone. This includes but is not limited to costs for subscription services you have signed up for, in which case you must contact the provider to suspend these.

    18. Claims made because your phone has been confiscated or is being held by any government agency (for example the Police).

    19. If you have a pre-pay phone we will not cover the value of any call credit on the phone if it is lost or stolen.
    E) The period of the insurance and how you can cancel it

    1. This is a monthly policy. We will renew your cover automatically every month for as long as you pay the monthly premium and until you tell us that you no longer want the insurance. If you stop paying your premiums, your cover will stop and your phone will not be insured.

    2. You have a 14 day cooling off period at the start of the policy during which you can cancel the policy for any reason and we will repay you any premiums you have paid. If you cancel outside that 14 day period, you will not get back any premiums youve paid.

    3. Either party can cancel the policy at any time by giving 30 days notice. You can do this either by telephoning us on 0844 848 4273 or by writing to Homecare Insurance Limited, Holgate Park, York, YO26 4GA. If we cancel your policy, we will write to you at the address for you that we have on your policy records. We will refund any premium that you have already paid for a period that you would no longer be covered for.

    4. We may also cancel your cover if you make a claim that we think is false or dishonest or if we think you are otherwise failing to act in good faith.

    howya doin, im in the same boat but the phone is in my brothers name and the insurance is in my name? i took the phone from my bro and decided to pay the insurance. so if i lost the phone who would have to claim? im a registered user of the phone in his emobile account and he is a registered user under my insurance, any ideas?

    A phone has to have been used with the SIM / Number / Named account associated with the insurance within 2 weeks of submitting a claim I'm afraid.

    So if the insurance is in your name, and you're using a different phone with a different IMEI, your up against it with the insurance company unfortuantely.

    Let me get this straight, you both have insurance on each of the mobiles, and are BOTH down as registered users on each phone? Or is you're a non registered user with the insurance company on his phone and that's the one you've lost?

    no, there is one mobile. my brother gave it to me coz he had a better phone anyway. so i had it insured in my name when he gave it to me. so the phone is in his name in emobile, but the insurance is in mine. so who does the claiming?

    In that case I'd assume you. If the phone is insured in your name and you were the person using it and you were the one who lost it then I'm sure that you have the right to claim.

    CPP wouldn't handle the claim if for example you gave the phone to a friend who is not a registered user on your insurance policy. Shouldn't matter what name the bill comes in for, it all depends on your insurance policy.

    No. As wherever you take out the insurance would need to see the phone in working condition. Also you'd be committing fraud by doing so.
