I won an auction tonight on Ebay,it was a phone and sold for 5 euro,I paid by
Paypal and then got an email from the seller that they wont sell for 5 euro because they bought it for 120 Euro, what should I do now?

    thanks in advance

Lodge a claim with Paypal, get your money back, post the worst possible negative feedback...

This happened to me once before.

Every seller takes this risk - if the seller was inexperienced you can have some sympathy with them, but thats always the chance a seller takes - they could surely have set a minimum or opening bid value?

They have sold 15 other things on their account, will they be able to leave me negative feedback then?

Open a case on eBay if you want but I would have some sympathy for the guy and accept the refund.

    I haven't been offered a refund though

you were entitled to that phone you won the bid for 5e. its nat your fault he didint have a starting price. its certainly not your problem what he paid for the phone. if he had 15 previous sales he new perfectly how to use the site i wouldnt have the slighest amount of sympathy for them

go into your paypal a/c .open the "resolution centre'' tab, write your complaint and sent it. he has 14 days to sort it out, otherwise paypal will take a very dim view of his actions.

If you paid by PayPal then you make a claim via PayPal and not eBay.

Hold off any negative feedback untill you get your money back, do not threaten to leave negative feedback if the seller won't sell and when you do finally leave negative feedback just state the facts. Something like "Won & paid seller refused to sell at what he concidered was too low a price". Request your refund from the seller but no reason you can't start a PayPal claim at the same time.

    Paypal:

This transaction cannot be disputed at this time. This is usually because the transaction has not yet been completed. If this is a completed transaction, please double check that the Transaction ID you selected refers to a payment that you sent.

Check your PayPal account and see if there has been a refund?

It shows as Unclaimed and I have an option to cancel the payment but if I do that the seller could say I have not paid, looks like I will have to wait until the 6th Feb to lodge a complaint,
    thanks

Take your money back, leave negative feedback and one star on all points then move on. Worst that can happen is the seller says you havn't paid and you have proof he said he wouldn't sell to you.

Same thing has happend to me a few times nothing you can do about it but you can make it look as bad as you can for the seller.

Same thing here,E Bay will not give you any satisfaction, not sure about Pay Pal,very frustrating I know.

Well I did the nice thing and accepted to cancel the purchase, not even a thank
you from the seller, but I seem to be able to still leave feedback, thanks for the replies all.

Just be honest and to the point with your feedback. Say the seller refused to go through with the sale, no explanation or anything. Make it negative, or neutral if you're feeling nice, though this is the very definition of a negative feedback case.

Is it possible to do anything more than just get your money back and leave negative feedback? The seller breached a contract, yes?

How, afaik it can't be done if the seller refuses to sell?

Not really, its a breach of contract so you'd need to see a solicitor to deal with it and go to all the hassel and expense of a court case, feedback is the way eBay regulate this, too many negative or not enough stars and the sellers account will be limited (never worked out exactly what limited means?) and then more negatives get the seller kicked off altogther.
