BIK question

    Hi all, a two-part question:

    I have a company car, in fact a 4x4, which I bring home in the evenings as I'm on call and it contains my tools and spares etc.

    Does this qualify as a Benefit in Kind?

    Part Two: My route to work includes (or rather, is much quicker if it includes) a toll station. At the moment the company pays the toll (via a tag) - as sometimes I'll be in various parts of the country working and will use a toll road.

    Is the payment of the toll to and from work also a Benefit in Kind (When you consider as before that I have the car at home as I'm on call)?

    Oh - I also have a private car.

    Given that you've the use of a company car even for private time, I'd imagine it should be liable to BIK. I don't think paying of the toll would be considered BIK, more an expense paid to you as Travel And Subsistence.

    Well I use my private car for private use, but the company car needs to be here in case I'm called out. The company pays the toll tag fees for the company car - so given that, is both the provision of the company car and the payment of the tolls a BIK?

    The toll can't be paid as T&S, because the cost of travel between home and one's normal place of work is not tax deductible - otherwise every employee in the country would be getting a portion of their wages tax free in this way!

    OP, when you say it's a 4x4, is it classed as a passenger vehicle or a van/commercial? The BIK treatment is different for each, and substantially less for a van (even exempt in some circumstances).

    You'll find definitive answer to both questions on revenue.ie.

    If you use the company vehicle for private use it is a BIK. Ideally you should not bring you vehicle home but instead drive to your workplace to collect it in the case of an emergency - however if you live quite close to your work place the extra mileage is not likely to be noticed.

    Toll charges to and from work are also a BIK.

    You will know the answer to both of these questions, given that you have a company vehicle.

    Is there a reason why you think the legislation has changed in relation to BIK and company vehicles? If something new has been introduced could you let us know? - thanks.
