Paypal dispute Questions

    Hi I'm just trying to find a few answers?

    I bought a car ecu off a guy from Poland/Litunina. He said he lives in Poland but the item was posted through the Lithunian postal service and the return address is a Litunian postal address also.

    How an ever I recieved the item yesterday and its missing a part, and the part thats missing reduces the value of it alot. The part thats missing is a chip in the ecu and it would have had to be opened up and taken out.

    I raised a dispute straight away with paypal as I had a bad feeling the whole time about this purchase but I just tought I was being a little paronoid. When I checked over the ecu I also realised it wasn't the same ecu he has advertised as it had a different ID code on it. BTW he didn't use a generic picture it was susposed to be a pic of the actual item with his user name and todays date on a piece of paper beside it.


    I contacted him then and told him that the ecu is'nt the one pictured and the chip is missing. He replied saying it is the ecu picture and the chip must have been stolen. He also asked for pictures of the box I received and that he only used clear plastic tape on the box. This was the first question he asked, not if I could be mistaken about the chip being missing or any other similar question. I also think the tape story is bull **** as there is clear plastic tape covering the duck tape he apparently didn't use. He is also adiment that the ecu is the same as the one picture but as I said above the ID codes on the two are different. He said he would contact the postal services at 3 o clock yesterday evening and I havent heard anything since.


    Now here is the good part he has the same item on a differnt site for sale using the same pictures and bumped the post 6 days after I purchased it. He had also been private messaging people on the site I bought it off trying to get them to pay pal him money for it also. Before I bought the ecu off him I asked him why he was selling it and he said he had just sold his car and no longer needed it, then on another completely other non related site I found pics of his new car with this ecu fitted.


    My question is when I raise my dispute futher as I think he is gonna stick with the item being stolen story, do pay pal ask for each others side of the story or how do they come to there decision on what happens with the money.


    I also contacted VISA as I payed for the item on a VISA card and they told me to write into them in Stephens green with all of the evidence. Do people have any experiece with anything similar?


    Do you's think I have enough evidence to show this person is a conman and not a genuine seller? IF pay pal side with the seller is it likely VISA will also?

    Any other help is greatly apprecatied. Sorry about the essay:)

    The only think I can say is that if your claim is that the product is not as advertised, Paypal will require you to return it to the seller, by registered post, at your own expense. Only then will you get a refund. Even at that, I'm not fully sure that Paypal will intervene and refund you. You'll have to wait for them to make their decision.

    Yeah the item isn't as advertised at all. I think it was all a scam. He sold me an item that is worth 100 euro for over 6 times the price. The whole thing stinks of a scam particullary because he is still trying to sell the same item on another site.

    Is there any reason why paypal wouldn't side with me considering the evidence if have or do they not get involved with purchases that aren't on eBay.

    Actually, they do involve themselves in outside of eBay transactions now, subject to a few restrictions.

    Reasons to not side with you are varied. Could be that the seller claims you never returned the product. If the tracking can't be verified, then you would fail. You've just got to be careful. Submit your claim, see what they say.
