JSA QA or not?

    Recently my DH went on JSB for 3 days and is working the other 3
    .
    I am on JSA for a while and my payment has been recalculated -my flat rate is now E169.50 (124.80 qualified adult + 44.70 half rate x3 kids)

    So my question is as we are on seperate claims should I not have the full personal rate of E188 and not be a classed as a qualified adult based on his claim.

    I have rung SW office twice about this and each time the information provider wasn't sure and said they would get a supervisor to phone me back - still waiting so I'm hoping to get me answer here instead.

    no i think they deduct your personal rate because your oh is getting a sw payment it should be on a letter you got when you received your jsa

    i dont think your allowed claim for a qa once the other person is receiving a sw payment

    im on 2 days a week and get 197 on jsa my partner gets 197 also we have 3 children and i get 57 from work

    they wont let you go over the max whick is nearly 400 on sw

    I know the max rate for 3 kids is 402.20. I did get a letter from them but it was calculating my husbands means and I understand that but it didn't mention anything about my rates.

    I don't know if I picked you up wrong but I am not trying to have him as a QA on my claim

    If I take his payment from the max rate I get 169.50 so that's probably where they got that figure for me?

    oh yes i see what you meen sorry yes they should have it as 188 not 124 im sure maybe its a mistake

    HEre is some information that can be found on the social welfare site.

    "Maximum Amount Payable to a Couple and Limitation of Payment where one is in receipt of JA and the other is in receipt of another social welfare payment.

    Where one member of a couple is claiming JA and the other is in receipt of one of the following payments:
    • Illness Benefit
    • Disablement Pension (when paid with IB or Incapacity Supplement)
    • Injury Benefit
    • Invalidity Pension,
    • State Pension (non-contributory)
    • State Pension (contributory)
    • State Pension (Transition)
    • Jobseeker's Benefit
    their combined payments cannot exceed the amount which would be payable if only one person made a claim. Where each would be entitled to a different rate of payment, the higher of the two amounts is the maximum amount which can be paid to the household. The couple will not necessarily receive this amount; it simply means that their combined payments cannot exceed this amount."
    How this works is that your partner is getting the full rate of Jobseekers benefit and you are the QA on his payment.
