doctors report

    I was wondering if anybody has had to pay for the doctors reports when making a claim i was just very shocked when my solicitor asked. I always thought they sorted that but now im thinkin is it because he is woried about wining even do they crashed into me and admitted fault was only minor damage 500 but i am injured. Can anybody advise me on what to do as i done have 280 for the report

    If you have been to a doctors and they have a report you can get a copy of if for EUR 6.35 via the data protection act.

    You cannot obtain a report under the Data Protection Acts. You can obtain medical notes/records under this Act but not a medico-legal report. I think it may fall under one of the exceptions in that it is a privileged document but I'm not at all sure as to whether this is the correct reason.

    TO the OP, somebody has to pay the doctor for their time in examining you and your records or other reports. How can you expect your solicitor to do that ? If you believe in your case, you must expect to contribute to it and paying for significant outlays such as for medico-legal reports is the least you can do.

    Don't forget that your solicitor is already investing his time and effort as well as covering postage, telephone, printing and court fees.

    Why are you suing them ?

    Is their insurance not covering your injury.

    I assumed that is what third party insurance was for.

    It's unusual for a doctor to prepare a report without being paid. You are the person who needs his report and hopes to benefit from it. If you are not willing to pay for it why should anyone else be?

    How can a third party insurance company decide on compensation for an injury without a medical report. While they may be agreeing to cover it, it is normal to go through PIAB to get an independent value for the injury.

    As I pointed out in the other thread on this issue, solicitors can not carry thousands of medical report costs. A small firm could have hundreds of piab applications, if the number was only a hundred then that firm would between medical reports and piab application fee be carrying 30000 in outlays. Most firms simply can't afford to do it. In the past some firms carried this as the area a good fee earner, but not it simply is not.

    Explain your money issues to the solicitor he may be willing to make an exception, but remember he will have to use his own money to pay your doctor to fight your case. Or explain to your doctor and ask can they wait till case is over.

    Some firms may be willing to cover the outlay. You should try around. I know one firm in the Dublin area which often covers the outlay.

    Its just most people are telling me the sokicitor does it and i am out of work at present and cant come up with the money so does that mean u hav to get a job in order to claim

    The unfortunate fact is that in recession times and with clients making ever more demands of solicitors while simultaneously demanding lower prices, solicitors can't be expected to front a few thousand on a PI case for reports.

    This is especially so where if the case is not successful, the solicitor will lose the money paid for reports and will not get paid. You would be amazed at how often a client will refuse to pay fees if their case is not successful despite being advised that they would have to do so.
