car b. think thats the general rule

  • Registered Users, Registered Users 2 Posts: 81,220 ✭✭✭✭biko

A guess is that your gf claims from B who in turn claims for himself and her claim from C.
    Your insurance company will know.

    B. b is always responsible for leaving suitable distance to a

Like has been said you claim off the car that hit you. Legally the car behind you should have left enough room so as not to be able to hit you if they got hit. Happened my father years ago and it was a case against whoever hit his car.

If car b is not responsible for the accident then she will need to go to the insurance company of car C. As it was this vehicle that started the chain of events for car b to impact into car A. How many impacts did she feel. If it's one then chances are that it was car C.
Car B's insurance wont pay out if they weren't responsible for the accident.

Car C is liable, as they pushed car B into car A.

We were in an accident like this. If car B stopped (and if the people car A can verify this), and car C pushed car B into car A then car C is at fault, car b would not have hit car A had it not been for car C. Car C would be liable for the damage to car A and B.

    Only one impact

Ok, next step is to get in contact with the insurance company of car c and inform them of what happened. If their insured confirms the details they should then deal with the claim, chances are they will look to take it over asap to keep their cost down.
Failing that you can claim on your comp and get your own insurance company to deal with it. (but this could take longer)
Personally i'd contact the third party insurer and deal with them directly, but if you feel that your getting messed around then get in contact with your own insurance company and ask them to deal with it, thats if your fully comp as you wont be able to do this if your insurance is only third party fire and theft.

Question to OP - were the Gardai called. What did they advise you. They were very helpful to us.

OP already said car B was stopped when car C hit them, after B hit A. Car A claims from Car B, car B can only claim for damage caused by car C, ie the rear end damage as front end would have been caused by hitting car A. There would have been 2 separate accidents therefore 2 separate people responsible.

This happened to me a few years ago. Both A and B claim from car C.

  • Registered Users, Registered Users 2 Posts: 19,102 ✭✭✭✭Del2005

I'd say C is at fault but I'd still claim off B and let them sort it out.

Car B hit you so they can then claim both off C, make sure to mention only one impact on the claim form.

  • Registered Users, Registered Users 2 Posts: 3,009 ✭✭✭OldmanMondeo

Lads, if CAR C hit the back of car B and pushed B into A, then C will be 100% at fault. But from what the OP is saying, B hit into A, so that is car B's fault, THEN after that accident, C hit into the back of B, a second accident.

A claims off B for damage to their car.

B can only claim against C for damage to the rear of their own car.

C & B will have to claim their own insurance for damage to the front ends of their own cars as this was cause by themselves.

Considering the conflicting advice you are getting here, you should probably contact a solicitor to be sure.

  • Registered Users, Registered Users 2 Posts: 3,205 ✭✭✭cruizer101

Thats not how I read it car b was stopped behind car a, car c ran into it pushing it into car a is how I read it. OP just says car b was stopped behind a when c hit it, not clear if that means stopped in a's bumper or stopped at reasonable distance behind.

I'd be getting in contact with your insurance company OP even if you only have 3rd party I'm sure they can advise somewhat.

you claim from YOUR Insurance Company and they deal with it all.

You dont need to worry if B or C is liable (its C anyway)

Not a good idea unless a last resort, it makes it messy as your policy will be affected by the claim at next renewal unless you have a)no claims bonus protection or b)your insurers have recovered the claim in full from C's insurers. (essentially your insurers pay you and then their recovery team pursue C's insurers)

C is 100% responsible based on the original details provided. Claim against that persons policy.
Their insurer will want to settle with your girlfriend asap so that you dont incur any additional costs i.e car hire/out of work expenses therefore increasing the amount of the claim.

  • Registered Users, Registered Users 2 Posts: 511 ✭✭✭EauRouge79

Oh, and you will also have to pay your policy excess if making the claim against your own policy. This is usually €125-€300.

  • Registered Users, Registered Users 2 Posts: 22,080 ✭✭✭✭Big Nasty

Car C obviously caused the accident but you can't claim from him as he didn't touch your car. You claim from Car B as they did the damage to your car (unfair to them I know but that's the way it is) and they claim from Car C for the lot.

  • Registered Users, Registered Users 2 Posts: 12,712 ✭✭✭✭R.O.R

This happened to us years ago, we were car B on the scenario. Car C took the wrong exit off the motorway and rather than heading on to another motorway came around a corner to find 2 cars stopped at a traffic light. Car C pushed us in to car A.

Car A claimed off our insurance and we claimed for the written off car from the insurance of C, along with all Costs associated with car A.
