Owed Money but not the Point

    Hi Guys,

    Just looking for a bit of Advice. Did a bit of work for a guy ( I'm self employed , fully registered , got premises etc ) , cost came to €100 . Not to shabby for a 17.3 inch laptop screen replacement which normally estimates round 160 - 170 .

    So long story short , he gave me a cheque that i couldnt cash , called him , got the normal yeah yeah yeah , invoiced him , emailed him etc , and then he replied 4 weeks later saying that the work wasnt up to scratch ( my bollocks it wasnt ) , and that he would give me half the agreed price .:mad:

    So technically , this guy has robbed my screen , as I asked him to return it if he doesnt want to pay for it , and still he hasnt done that. Now to be honest , its not the money im after anymore , but I'd like to give this guy a little bit of grief . I've done some research and it looks as though hes a pure cowboy , and hes done it to many other ppl before. Any suggestions to even get some sort of satisfaction ?

    One local business that gets a lot of walk-in customers has a sign up, saying "any work for <<list of names>> must be paid for in advance".

    It's very clever: no accusation, threats, claims ... just a clear statement of business policies. And pretty much everyone who sees it understands.

    I know of one business that used to put bounced cheques in a place where people could see them, not on display as such but visible enough for the nosy parkers to see.

    I also heard of a person who would wait in reception and everytime some would come to the desk he would enquire about getting payment for a bounced chq.

    You could also go around to his workplace/house and refuse to leave until he pays or returns your property. you could be louder than usual when there are people around when you explain your problem.

    long story short - Dont accept cheques! Thry are nothing but hassle anyway! Also you have tryed to contact him so now your best bet is smal claims court

    I dont think the OP can use the SCC, that is only for cunsumers as apposed to business. A solicitor would be the OP's only option.

    I have seen signs requiring pre-payment from some business in the local timber yard and never put 2 and 2 together. Very handy thing to do.

    I used to do credit control and found turning up to someone's premises always made them pay me.

    If I were you I would turn up unannounced and tell him you are here for the laptop screen.

    It is a criminal offence to obtain services knowing that payment on the spot is expected and fail to pay. Irt is also a ccriminal offence to tender a cheque knowing that it cannot or will not be cashed. Go to the Guards. They will tell you it is civil, but don't be put off.
