    If someone takes a photo ina private shopping centre without permisssion do they have to surrender the photo and or camera. Is it a criminal offence

    No. They own the photo and only a court can order the removal of the photo.

    At most, the owners of the shopping centre can ask the photographer to leave, and if he/she fails, they can be charged with trespass.

    If the photo has broken any law, then the court needs the photo for evidence. The Gardai can sieze the memory card containing the images, if required. If no law has been broken, then you have no right to have the image deleted.

    Either way, only a court order can have the image deleted.
