one year old tv stopped working

    hi,
    Im hoping to get some advice for my dad. on 3rd january 2011 he purchased a 26" bush tv. last night the screen went blank,no sound,no picture it just stopped working. he has the receipt and returned to the store where it was purchased. they said the warranty expired on 3rd january 2012 and really didnt want to know. does he have any rights regarding this . its only turned on in the evening for a short while so would be expecting to get some more time before it stopped working. would any consumer act cover this. thank you in advance for any replies

    Yes, this would be covered under consumer legislation if he purchased the TV as a consumer and not as a business.

    Warranties are a perk, they do not and can not supersede or invalidate your legal rights.
    If the TV failure was not caused by misuse then you are entitled to reject the goods and get your money back (refund), have it repaired at no cost or have it replaced at no cost. Neither you nor the retailer can dictate the terms.
    Deal only with the retailer because that's who you have the sales contract with, the manufacturer has no legal obligation once the warranty has expired.

    Thank you for your reply. he is a bit unsure about what to say. he has the receipt and my mother explained this. the store said sorry warranty has expired there is nothing that we can do. I will send him there tomorrow armed with some information.

    Simply put, the store is incorrect. As mentioned, the warranty is in addition to your consumer rights, it cannot replace them.

    Your father should remind the store that his contract of sale is with them. Under consumer law, he is entitled to expect a product to last a reasonable amount of time (assuming no undue wear & tear). Therefore, it is up to the store to deal with him.

    Assuming that your father is not to blame for the demise of the TV, then the shop should offer him a replacement, refund or repair.
