Blood test without being breathalysed first.

    Hello,

    A person was involved in a minor car accident. The police were called and took the person to the police station and gave them a blood test. Any idea why they would have done this without having breathalysed them first ?

    Was the smell of their breath igniting fires?

    A roadside breathtest is not necessary if the Garda is able to make his mind up without it.

    Simple answer there is no need to provide a road side test. A Garda can form the opinion from observation then arrest for the taking of a sample.

    She said she'd had a glass of wine earlier, so maybe that's it. I thought they always did a breat test. I'm assuming the other party much have rang the Gardaí because they had some suspicion.

    As it takes longer for a doctor to arrive so less alcohol in the blood by then.

    That's nullified by the fact that the intoxalyser subtracts 17% from the result.

    Maybe so, it's a pensioner. She's up to ninety now anyway. Didn't get any sympathy from me, that's fot sure.

    So from what I gather, for a first offence there won't be a trip to court unless she's over 100mg per 100ml ?
