Leaving my job, holiday entitlement?

    Hi Guys,

    Thursday is my last day working my notice in this job, starting a new one on sat. I have just realised I still have 4 days holidays to take and I know for a fact they wont pay me for them.


    Am I entitled to leave today and take the rest of the week as hols??

    They are not allowed to pay you instead of taking holidays, except in the case where you are leaving, like this.

    I think they would be legally required to pay them in your case, but it might be easier to just take the holiday days instead of chasing them for payment.

    Thanks for the quick reply!

    I am there 6 months so entitled to 10 days hols, they put me on a holiday freeze until jan as my boss went out sick, so ive had the last 6 days off as hols. I found another job when i was off and start on Saturday.

    I know other staff that have left are chasing them for payment for their hols too, when i go in today I will ask for the rest of the week as hols.

    Is there anything I can do if they say no???

    They do have the right to refuse you taking leave, in which case they'd have to pay you for them.

    When you ask for them, be sure to mention that you may as well use your leave now, rather than being paid for it at the end. If they know they might save a few quid sort of by letting you finish up early, you might have a better chance. They won't really save money, but it might sound better to them.

    If they don't let you take them, then maybe keep asking them (nicely & politely) for a written statement of how much leave you're owed payment for once you finish up.
